A proposal that would overturn Upland’s ban on medical marijuana dispensaries will not be decided in a special election.
Superior Court Judge David Cohn this week denied a request by the California Cannabis Coalition to hold a special election that would decide the issue, opting instead to leave the matter until the general election in November 2016, according to a report in the Inland Valley Daily Bulletin.
The ordinance would require each dispensary to pay $75,000 in licensing and inspection fees every year to the city, a proposal the city regards as a tax. By law, any such tax must be approved by the voters.
Cohn said the city is not against voting on the measure but believes it belongs on the November 2016 ballot, the report stated.
