Opponents of San Bernardino’s across-the-board ban on medical marijuana dispensaries are fighting back.
A lawsuit filed Tuesday on behalf of one dispensary businesses in the city charges that the city council violated the state’s open-meeting several weeks ago when it decided to crack down on all dispensaries, according to a report in the San Bernardino County Sun.
The suit, which asks that the council’s decision be struck down and that the dispensary, MJ Dispensary, be reimbursed by the city for legal costs. The council is also scheduled to discuss those matters at today’s council meeting during a closed session.
Also on the agenda is an open-session discussion regarding actions taken against marijuana dispensaries operating in the city, the report stated.
Medical marijuana is legal under state law but not federal law. Supporters of medical marijuana dispensaries argue that it’s better for people who need that substance to get it from a safe and regulated business than for them to buy it from drug dealers.
